Motorhome and the law

Does anybody know where one stands if you are parked up in a suitable layby and have had a drink and the police come along, can you be breathylised?

I seem to remember a post on this on another forum a while back the general opinion was that if you had the keys to hand you could be done for drunk in charge but I'm not sure

I had a friend that got nicked sat parked in the street outside his house as he sat having a couple of cans . A layby is classes as part of the highway.

When parked on any public road you could be asked to move by the police and it is the responsibility of the motorhome owner to make sure they are in a state suitable to do that. So if you have to park in a layby (why) best to leave the beer in the fridge!!!

Thanks everyone. I was asked the question but didn't know the answer. Around my area in the Brecon Beacons there are many laybys from which you get some amazing views and I often see motorhomes parked in them.
